Uncle in court for raping two-year-old niece

A mother is distraught after her brother took advantage of her two-year-old baby

A 27-year old uncle has been denied bail after he allegedly raped his two year old niece. The accused appeared at the Pretoria North Magistrate Court and faces a charge of rape. The incident took place on the 24 of September in Pretoria when the mother of the victim took her two kids to visit her own mother. It was around 8pm when when the lights went off during loadshedding when the uncle allegedly took his niece to the bedroom. The victim's mother and her older child, a boy, were washing dishes in the kitchen.

MOM FINDS BROTHER RAPING HER CHILD

The mother said she heard the child cry and when she looked for the child and found the child in the uncle's room. The uncle had been raping her. It is alleged that the uncle threw the child on the ground, and while crying, she showed her mother where it was hurting. The following morning, the child was taken to the hospital where it was confirmed that indeed the child was raped. The mother reported the matter to the police and the uncle was arrested four days after the incident.

IF RELEASED SAFETY OF MOM AND CHILD COMPROMISED

During his bail application the accused cited ill health, claiming being behind bars was worsening his condition. However, the State Prosecutor, Advocate Tumelo Letaoana told the court that the accused had no exceptional circumstances in his application. "If he gets bail such might undermine the bail system considering, the seriousness of the offence.  Him being released on bail might disturb public peace,"said Letaoana. In delivering the judgment, the magistrate said should the accused be released the safety of the victim and the mother could be  compromised. The matter will be back in court on the 13th of December.
