Bail judgement in the Nomzamo tavern shooting matter could not be heard on Thursday following security threats of court personnel and the public in the gallery prior to the proceedings. Residents of Nomzamo who lost their loved ones gathered outside the Orlando East Magistrate Court and threatened to wreak havoc should accused number 3 be granted bail. Court proceedings were delayed because of this. The court only has one entrance and exit and this is a major concern since no one could enter or leave without being threatened.
DANGER
The magistrate had to be escorted in by heavily armed police members for his safety because the residents did not want him to go in. Inside court all the family members that were allowed in had to go out so they could be searched for any dangerous weapons before they could be let in again. The accused were quickly rushed back to the holding cells because it was not known how the reaction was going to be should accused number 3 be granted bail.
AN EMOTIONAL MATTER
The magistrate presiding over the matter AW Morton said this was a very emotional matter. This is a very emotional matter, emotions are very high. Today we can't proceed.I concur and confirm that we can't risk lives and state infrastructure. The matter is postponed to Monday at the Johannesburg Regional Court. "
?CASE MOVED TO REGIONAL COURT
NPA's Phindi Mjonondwane explained that due to the high risk and size of the court, the matter will be moved to the Joburg Regional court for bail judgement. She said they liaise with the community leaders and explained that any outcomes of the matter will be based on court processes that were thoroughly investigated. "We have been pushed into a tight corner but we are in a listening state. We met with community leaders and asked them to allow the court to proceed without posing any threats." She said residents demanded that the Minister of police, justice and home affairs meet with them before bail judgement for accused number three could be heard. They said if this is not done they will petrol bomb the court building. Security assessments were done and SAPS confirmed that the matter could not proceed.
