Former Tshwane mayor Solly Msimanga's case against his sexual abuse accuser dismissed

Solly Msimanga says the justice system has failed him

A perjury case against former Tshwane mayor and Gauteng DA leader Solly Msimanga's sexual assault accuser has been dismissed. Msimanga was accused of the assault by a fellow DA member and former MPL Nkele Molapo in 2019. Molapo's case against Msimanga was dismissed in 2021 due to lack of evidence. Msimanga took to social media today where he vented his anger against his accuser. He could not stand as the DA Joburg Premier candidate because of the allegations levelled against him. 

EXPRESSING HIS ANGER

"I am now very much angry. When a man is accused of sexual harassment, they get berated and subjected to a court of public opinion, destroying the lives of those who are falsely accused and their families along the way. The accuser then gets to continue with their lives as if nothing ever happened, while the real victims still have to deal with the humiliation and badly scarred family members, who have to live through the ordeal. I just got this message only today, after two years of waiting for prosecution,'" he said. The message that Msimanga received on his mobile phone, just after midday, read: "Message from SAPS Investigation in BROOKLYN, ref nr CAS 112/10/2020 - Case has been withdrawn and the docket has been closed."

FALSE ACCUSATIONS 

Speaking to Zimoja Msimanga said the case against him was dropped because of the inconsistencies of the statements by the accuser, and the lies which were uncovered by the investigators.  "When and where do victims of false accusations of rape and sexual harassment get justice? Will those who falsely accuse men continue to do this, knowing that they'll never be prosecution?" One Facebook user wrote: "Start a private prosecution for Slander." Another one said: "The prosecutor realised there's no case here. "Go ahead and file for a perjury case against the perpetrator, and also file for a civil claim for emotional, traumatic, and other damages." 

DA TOOK DRASTIC MEASURES AGAINST ACCUSER 

The DA terminated the membership of Molapo after she had accused Msimanga of sexual harassment. At the time, the DA issued a statement that said:"Ms Nkele Molapo's guilt has been tried by a fair process of the DA federal legal commission, and after she appealed, her guilt was confirmed by an appeal panel of the federal legal commission. The sanction imposed upon Ms Molapo is the immediate termination of her party membership, against which there are now no possible further internal appeals.'
