The Senzo Meyiwa murder trial has resumed with a new judge, Judge Ratha Mokgoatlheng presiding. Mokgoatlheng re-read the rights of the five accused and explained to them that they have to plead again because the trial is starting over.
State prosecutor George Baloyi said proceedings under Judge Tshifhiwa Maumela were now a nullity and therefore asked for the court to stand down until Tuesday to sort out matters of legal aid. Mokgoatlheng said: "We can't waste the morning and the afternoon, the pre trial can be held today. I can make an order to get a Legal Aid representative to come and assist with the forms that are needed to allow the accused defense to get financial instructions. From what I understand a lot of time has been spent here." The Judge told the accused that they have a right to apply for bail.
The court heard that the state could be paying for the defense of the accused since it's not their problem that the trial is starting over. The form that needs to be completed from Legal Aid is for Legal Aid to fund the legal fees of the accused moving forward because the trial is starting anew.
Meyiwa was gunned down in 2014 at his baby mama's (Kelly Khumalo) home in Vosloorus. The accused Muzikawukhulelwa Sibiya, Bongani Sandiso Ntanzi, Mthobisi Prince Mncube, Mthokoziseni Maphisa and Sifisokuhle Nkani Ntuli are charged with premeditated murder, attempted murder, robbery with aggravating circumstances, possession of firearms without a licence and possession of ammunition. All have pleaded not guilty.
