Guilty as charged!

Sifiso Mkhwanazi, who is accused of raping and murdering six sex workers, has been found guilty of premeditated murder and all other charges against him. Although Judge Cassim Moosa acquitted Mkhwanazi on the charge of robbery with aggravating circumstances, he replaced it with a charge of theft.


THE JUDGMENT 


Judge Moosa read out his judgment at the Gauteng High Court sitting at Palm Ridge and said he rejects the version of the accused as being false. "I have looked at the merits and demerits of this matter coupled with the totality of the evidence before me and accordingly reject the version of the accused as being false beyond reasonable doubt. I do accept the evidence of the state witnesses. I further find that under the consideration of the totality of the evidence, the prosecution has discharged the honours to prove beyond reasonable doubt that the accused has committed the crimes as charged." Moosa added: "Except for the charge of robbery on count 20, the accused has failed to give an explanation of innocence which is reasonable possibly true and his version is accordingly rejected as beyond false. In the circumstances I rejected the version of the accused as set out in the section 220 admissions as beyond false and find that the accused had acted with premeditation, planning and had formed an intention to kill the deceased." Judge Moosa said he found that the accused did unlawfully have sexual intercourse with all the deceased. "I further find the accused did unlawfully and intentionally defeat and obstruct the course of justice by concealing the bodies of the deceased and which acts defeated and or obstructed the administration of justice. In the results I find as follows: Guilty on six counts of murder, six counts of rape, six defeating the ends of justice, one possession of ammunition ,one illegal possession of firearm and one of theft," said Moosa.

In conclusion judge Moosa said Mkhwanazi must be sent to Sterkfontein Psychiatric hospital for mental observation before he delivers an appropriate sentence. Psychologist Dr Gerard Labuschagne explained that, "We usually consider two or more murders as being serial in its nature. The accused in this matter is classified as such. Although killing sex workers isn't that common but the sexual element is very common in our South African serial murders. The judge said these were premeditated murders therefore he will likely get six life sentences for each of the murders. The judge also recommended that he be sent to Sterkfontein which I think is a very good idea. Him being sent there is not to determine whether or not he is responsible for his own behaviour because that is too late for that, but so that he can he be assessed in terms of him being a dangerous criminal."
