The case against Economic Freedom Fighters (EFF) leader ,Julius Malema, who is standing trial at the East London Magistrates Court in the Eastern Cape alongside his bodyguard, Adriaan Snyman, has been postponed to November.

CLOSING ARGUMENTS 

The National Prosecuting Authority regional spokesperson Luxolo Tyali said the case was postponed to 1 November for the state and defence to present closing arguments after the defence closed its case. The two are facing charges of unlawful possession of a firearm, unlawful possession of ammunition, discharge of a firearm and reckless endangerment to a person after the EFF leader fired shots during the party's 5th anniversary at Mdantsane's Sisa Dukashe Stadium in July 2018.

HE INSISTS IT WAS A TOY GUN

According to Tyali, the prosecution closed its case last year after leading the evidence of 19 witnesses. "Malema and Snyman subsequently made an application for a discharge, according to Section 174 of the Criminal Procedure Act, which was dismissed by the court," Tyali said. He added that the defence led the evidence of two expert witnesses, in firearms control and forensic ballistics, for Snyman. Malema took the stand in his defence," he added. Malema was cross-examined by state prosecutor Advocate Joel Cesar whom the EFF leader accused of wanting to build his career using his name and destroy his 'reputation'. On Wednesday Malema told the court that his case was politically motivated and that the people who were pushing for his prosecution did not understand that on the day in question, he used a toy gun as they were celebrating the anniversary of his party.
