ANC MP accused of wife's murder going back to Parliament

Sibusiso Kula will be back in court on 6 September

ANC MP Sibusiso Kula who is accused of murdering his wife last year will soon return to work in Parliament. This was revealed today in court when he appeared in the Orkney Magistrates' Court on charges of murder. The matter was postponed after he requested to be provided with the list of witnesses which the court ordered should be provided to Kula by 03 July 2023. Kula told the court that since he will soon be returning to Cape Town for work, he needs to know the witnesses so that he doesn't interfere with them. 


MURDER ACCUSED


Kula (34) is charged with murdering his wife Jennifer Motlhomi, who was found dead at their home in Orkney, North West, in November last year. She was found with a stab wound on her back but the object used has not been recovered. Kula told police he was not at home when the incident occurred. After a thorough investigation by police, Kula was arrested on January 20 and charged with murder. 


NO CHANCE


Kula's application to have his murder case struck off the roll was rejected by the court and his defense indicated to the court that, they will register a review application following the judgment. In their application, they argued that his rights were not explained to him, and thus can be used against him in a subsequent trial. They further questioned the charges levelled against their client.

The state prosecutor, Advocate Phuti Sekoadi opposed the application and argued that, the matter is still under investigation and that the current charges are properly drafted, as they are in line with the evidence in the docket. Sekoadi further explained that, when investigations are completed, the state will decide whether the charges should be amended. "We urged the court to dismiss the application as it had no bearing on the charges levelled against the accused and the court ruled in favour of the state," he said.

Kula is currently out on R50 000 bail, granted by the High Court of South Africa in the North West Division, following his appeal on the Orkney Magistrates' Court decision to deny him bail. He will be back in court on 6 September 2023.
