Robbie Malinga’s widow to take TS Records to court

The Gauteng ANC provincial secretary Thembinkosi "TK" Nciza is accused of misappropriating a significant amount of money from the late Robbie Malinga’s royalties. Nciza, along his former business partner and Radio 2000 presenter DJ Sbu Leope, of the now defunct TS Records, are accused of defrauding the late Malinga, by his wife, Ann Malinga.


SHE ONCE WROTE TO PANYAZA


In December last year, Ann even wrote a letter to Gauteng Premier Panyaza asking for his assistance in regard to his ANC colleague Nciza having defrauded her husband, but she never received any respond. Seeing that Lesufi, who is also the chairperson of the ANC in Gauteng, was not entertaining her, Ann then wrote a letter to Nciza’s attorney, Dumisani Motsamai, to explain her hubby’s missing royalties. On March 1st, Bongani Mdakane, representing Mdakane Attorneys Inc. wrote a letter to Nciza about Malinga’s royalties. "Our client has appointed us to assist her in communications with your TS Records ("your client") pertaining inter alia the accounting of royalties for all works owned and/or controlled by your client in which Robbie Malinga participated as a featured artist, producer, and/composer. "We look forward to addressing all related issues with you, intending to find an amicable solution."


Ann believes that Universal Music, the then parent company of TS Records, which distributed its music, is also involved in pulling the wool over her eyes. She told ZiMoja: "Both Universal and TS are involved in the same fraudulent scheme with regards to Robbie’s work. "Universal responded by distancing themselves from the mess, putting it all in TS Records. TS Records have not accounted. Their lawyer Dumisani’s went AWOL."


SHE IS DETERMINED TO KEEP FIGHTING 


Never the type to give up on fighting for her late husband’s royalties, Ann also wrote another letter to Universal Music, demanding answers. Her lawyers wrote to Universal Southern and East African managing director Manusha Sarawan on May 17, to get answers after TS Records" blue ticked" them. 

The letter states: "Our client’s instructions are that, during Mr Malinga’s lifetime, he entered into a recording agreement with you ("The Recording Agreement"). Furthermore, Mr Malinga participated extensively as a producer, performer and/or composer in recordings owned and/or controlled by TS Records ("TS Recordings"). The letter continues: "Kindly furnish us with a copy of the Recording Agreement with all its iterations (if any) as our client is not in possession of same. "Additionally, we requested all agreements for all TS-owned Recordings that our client participated in as a producer, performer and/or composer. "TS Records legal representative Mr Dumisani Motsamai from Morolong Attorneys informed us that his client is not in possession of the said agreements. The reason being, according to Mr Motsamai, they have not received the letter. “We are not aware of the second letter, I will check it out tomorrow and respond to you,” said Motsamai.
