The case involving a former male nurse and a patient is expected back in court today. Philasande Khumalo who was employed at Hlengisizwe Clinic in Hammarsdale is facing a rape charge and will take a stand at Camperdown Magistrate court, outside Durban, in KwaZulu Natal (KZN).
A MINOR AT THE TIME
The incident is said to have taken place inside the premises of Hlengisizwe, where it is alleged that the rape happened. Khumalo took to the stand on Tuesday where he detailed on how he allegedly raped his girlfriend, who was 16- years old at the time. Khumalo told the court that the minor was his girlfriend and that they had been dating for a year.
IT HAPPENED INSIDE HIS OFFICE
He confessed that the alleged rape took place inside his office at the clinic. "On the day of the incident I walked out of my office and saw her seated on the bench with other patients, I signalled to her to come to my office. When we were inside my office, we began kissing and that led to us having sex. Both of us were aroused and wanted each other badly. We were interrupted by the bed because it was making too much noise. We then decided to carry on having sex on the floor because we were afraid that someone from other offices next to mine were going to hear us," he confessed. Magistrate Linda Lewis and Prosecutor Verashya Moodley were not convinced of Khumalo's statement and cornered him with questions over the allegations that him and the victim were dating.
A WELL KNOWN INKABI
Lewis and Moodley asked Khumalo if he knew the family of the victim, her home address and the school she attended but he said that he had no clue and did not care about knowing her profile.Khumalo went on to say that the reason he never went to check on the victim in her area was because he feared the father of the victim since he is alleged to be a well known inkabi.
HE MAINTAINS THEY WERE LOVERS
When he was asked why he decided to have sex with the victim in his office since they were lovers, Khumalo simple said it was because it had been a while since he last saw her girlfriend and that on the day of the alleged rape, they both wanted each other. The case resumes today and the investigating officer is expected to take the stand and testify.
