Missing Joshlin Smith matter headed to the High Court

The case involving missing Joshlin Smith’s mother, Kelly Smith, her boyfriend, Jacquen ‘Boeta’ Appolis, Stevano van Rhyn and Lourentia Lombaard has been moved to the High Court. The four individuals, who are accused of playing a role in the disappearance of the missing grade 1 learner from Diazville Primary School, made a brief appearance at the Vredenburg Magistrates Court today.


CHARGES


The group is facing charges of kidnapping and human trafficking for the purpose of exploitation. The prosecution claims that Joshlin was allegedly sold for R20,000. The court has decided that the trial will take place at the Western Cape High Court in the Cape Town CBD. "The matter will be heard in the high court," stated the prosecution. The defence team for the accused did not raise any objections. During the court session, Kelly, Joshlin’s mother, was visibly pregnant.

During the previous court appearance, the prosecution informed the court that their investigations are still ongoing and all information related to Joshlin’s disappearance was being thoroughly investigated by the police. The prosecution also mentioned that they have received forensic reports and cellphone data downloads, which are currently being analysed. The case has been adjourned until September 16, and all the accused individuals remain in custody.


NEW EVIDENCE 


NPA Regional spokesperson, Eric Ntabazalila, said new evidence had emerged, but he did not disclose the details. "One cannot rule out additional charges or a new accused being added to the docket. When we come back on September 16, the state will hand over a letter advising the court that the matter will be transferred to the Western Cape High Court. At the next court appearance, the accused will be handed an indictment,” he said.
