The five men accused of murdering former Pirates and Bafana Bafana goalkeeper Senzo Meyiwa are back in court. They appeared again today at the Gauteng High court in Pretoria for the continuation of their trial. The first detective, who arrived at the crime scene at Kelly Khumalo's home in Vosloorus, Sergeant Thabo Mosia took the witness stand. It was brought to the court's attention that a statement that was read to the court contradicted some of the things that the sergeant mentioned in his testimony.

CONTRADICTIONS IN THE STATEMENT

The statement was brought forward by Advocate Zandile Mshololo, who explained that it was in the public interest for the statement to be read because it contained contradictions against Mosia’s version of events. Advocate Mshololo is representing one of the five accused for the murder, Fisokuhle Ntuli.
She pleaded with judge Tshifhiwa Maumela, who granted the application to use the statement by now deceased Brigadier Jonas Ndlovu.
Mshololo said the use of the statement  is for the purposes of appeal if her client is convicted.
Mshololo then crossed examined Mosia, who in closing said he left the crime scene to attend to other cases hence he could not answer some of the questions.
"So you left a crime scene where someone had been killed to attend to cases that had no casualties?asked Mshololo.
Mosia replied:" I treat all crime scenes the same."

HE LEFT MURDER SCENE FOR A ROBBERY

It was revealed that the reason why Mosia left Meyiwa's scene was to attend to a robbery in Zonkizizwe. Mosia was asked to give the case number of the robbery scene he claimed to have attended but the state prosecutor objected, stating that he does not see the relevance of the question.
When the judge asked Mosia if he has the case numbers, he said he did not have them. Mosia said he was aware that Meyiwa was a well known person but he had to do his job as he normally would.  Advocate TT Thobane,  representing the four accused, asked Sergeant Mosia if he kept a record book of all the scenes he attends to which he said yes. Advocate Thobane then asked if Mosia recorded events of that day and whether he still has it.
"It's full and I don't have it anymore," said Mosia.

MANY MISTAKES

?
Advocate Thobane asked Mosia to explain what a task team is. He said there's a National Provincial Management Task Team and a Local Criminal  Records Centre.
Thobane asked if a certain Mhlahlo was part of the task team but Mosia said he wouldn't be able to answer about witnesses who hadn't taken the witness stand. Thobane said he would call a witness, who will testify on the protocol to follow when arriving at a crime scene for the first time because it seems Mosia made a lot of mistakes. The trial continues tomorrow.
