The murder trial of Pirates and Bafana bafana goal keeper Senzo Meyiwa continues today. Meyiwa was shot and killed in 2014 and the truth surrounding his death has been difficult to uncover. Yesterday a second witness took the stand, Sergeant Patrick Mthethwa who was stationed at the Vosloorus SAPS. He had been on standby on that eventful night. Prior to Mthethwa relating his version of events the defence of four of the five accused objected to the sergeant taking the stand.
Advocate TT Thobane claimed the sergeant had been watching the court proceedings when the first witness was on the stand.
However Thobane was told he could raise his issues during cross examination.
THE CRIME SCENE
Mthethwa was first questioned by the state prosecutor Advocate Baloyi who wanted him to explain what transpired when he got to the scene and after that.
Mthethwa said he had received communication via radio control that there was a shooting in progress.
"We received it around 20:53 and rushed to the said house. When we got there, there was an uncle, named Themba, who claimed that there was a shooting but he's not sure what happened because he had just gotten there. He opened the house for us but nothing was clear to us at the time, so we rushed to the hospital because Themba told us that's where we would get info,"said Mthethwa.
He added that as they were driving into the hospital a BMW was driving out.
" That BMW was being driven by Kelly Khumalo, who was identified by my colleague because I didn't know who she was. When we got inside the hospital we spoke to a nurse who directed us to Kelly's mother, MaKhumalo, as well as showed us the body of Meyiwa."
Mthethwa said they left the hospital with MaKhumalo in the same car going back to the house.
" The first thing we did when we went back the second time was to cordon the scene. Thereafter we went inside the house "explained Mthethwa.
WHOSE HAT WAS IT?
Mthethwa said as they were going through the scene Captain Zwane arrived.
"Captain Zwane is the Head of Detectives so we told and showed him what we saw. After that he had a chat with MaKhumalo, interviewing her while we waited for the photographer and took some notes.
We also showed Zwane a hat and the bullet projectile, as well a crutch but we did not pay much attention to the crutch because we were told it belonged to one of the victims,"said Mthethwa. There was an issue surrounding a hat that was found in the house.
"The hat was in the kitchen , Kelly's mom came to us and said there's a hat that belongs to the suspects. We saw the hat on the floor but we had no knowledge who it belonged to. Thereafter Kelly mom picked it up to show it us and we asked her to put it back."
HIGH PROFILE CASE
Mthethwa said the photographer eventually arrived at the scene and introduced himself as Constable Mosia.
"Shortly after that the task team arrived and the person I knew from that team was Brigadier Ndlovu- I'm my certain I heard that he is no more. The team said this was a high profile case they would take over and asked us to excuse ourselves. Then we just went outside to guard the scene and I think around 10pm we had left the scene and went back to the police station."
Thobane asked the witness if he had been watching the proceedings but Mthethwa denied these claims, stating that he had no TV on his phone only WhatsApp. He said it was negligent of Mthethwa to rush to the hospital leaving the crime scene unattended.
"You left the scene compromising it and risking contamination, you even said it yourself that when you got back from the hospital there were already people outside the house, said Thobane.
"But what scene would we be protecting, we had no knowledge of what transpired. When we received a complaint, it said there was a shooting in progress. The uncle said there was a fight and a shooting happened and everyone was in hospital. That's why we rushed there to get information. I asked my other colleagues to come to the hospital while I rushed back to the house, that's what made sense to me at the time," said Mthethwa.

THE PEOPLE IN THE HOUSE
Thobaane said the witness should locate his pocket book and bring it to court. "I "I put it to you there are no people who ran away, the shooting incident happened amongst the people who were in the house," said Thobane, to which Mthethwa responded, "I don't know I wasn't there when the incident happened."
Court was adjourned to this morning.
