The North Gauteng High Court once again adjourned the Senzo Meyiwa murder trial yesterday after the defence of the accused requested that a photo album downloaded from one of the accused phones be made available for their cross examination. Advocate Charles Mnisi was cross-examining Constable Sizwe Zungu when the issue of photos taken on the night of 26 October 2014 was brought up.
Advocate Mnisi started his cross examination by focusing on the events of the day Zungu claims he was at the hostel with the five accused. The court heard that Zungu was with the accused at a hostel, driving around in a red Fiat Uno. Zungu says it was the five of them in the Uno the first time he went out. He said in the car, there was was Mthoko, Gadla, the driver, another occupant whose name he can't remember, and accused number 4. He says accused 3 was wearing a black Adidas short. Mnisi took Zungu through a picture showing two men drinking from cans on one side of a red car and another man on the other side wearing a navy-blue cap and a top. Zungu said accused number three was wearing a lime t-shirt and had a necklace at the hostel. However, in the pictures displayed in court, the accused is wearing a beige top and there's a necklace. The state says they don't have any other pictures. "I am hamstrung to continue with cross-examination without further information. The court would recall that there were pictures downloaded from the accused's phone," said Mnisi.
The state said the photos can be made available to the defence by today. Mnisi insisted the cross-examination is a sequence and without them, he cannot continue with the cross-examination. Judge Ratha Mokgoatlheng then ordered the lead investigator in the Meyiwa case Brigadier Bongani Gininda to make the pictures available today so that the trial can proceed. "For that reason, this court adjourns until so that the defence can be furnished with the master copy of the pictures," Mokgoatlheng said. The trial continues this morning.
