Defence claims accused was assaulted until he messed himself up

Judge Ratha Mokgoatlheng said he was taking judicial notice on the question of police being heavily armed

The defence in the Senzo Meyiwa murder trial started cross-examinations of witness, Constable Jabulani Buthelezi - the officer who arrested accused one, Muzikawukhulelwa Sibiya, in Tembisa, on the 30th of May 2020 and transported him to a local hostel, Vosloorus, Aeroton and then Pretoria.


POKING HOLES IN THE TESTIMONY


Buthelezi has denied any knowledge of the accused being taken to Lethabong, where the defence claims he was assaulted and forced to sign a confession. The police officer told the court that they took the accused to his shack to change his pants as he complained that they were uncomfortable. Advocate Thulani Mngomezulu told Buthelezi that the accused was beaten up and "messed himself up" and that is why they took him home to change his clothes. Buthelezi said during the arrest the accused was wearing Brenthood trousers which he complained about getting messed up because he was on the ground. "He also didn't want to be arrested in those trousers and I wasn't going to deny him that when he was asking politely,".


NOT TAKING CHANCES


Judge Ratha Mokgoatlheng said he had taken note of the witnesses being asked why they were heavily armed. "Have you ever heard of accused persons being transported with the normal vans of the State being taken to court in the morning or from court in the afternoon? They have been hijacked by their supposed comrades or colleagues, and the police have been shot with AK47s. Have you ever heard of that? And those prisoners have been released by these AK47-wielding Samaritans," the Judge asked. Buthelezi then told Mokgoatlheng that such incidents are the reason why they appear heavily armed in such cases.
