Whose hat is it anyway?

All accused were excluded from swabs taken from the crime scene

As the Senzo Meyiwa murder trial continues, forensic analyst Captain Mmampshedi Masetla revealed that DNA evidence links none of the five accused to the crime scene in Vosloorus,which happened in October 2014. The five men standing trial in the slain goalkeeper's murder trial are Muzi Sibiya, Mthobisi Mncube, Mthokoziseni Maphisa, Bongani Ntanzi and Fisokuhle Ntuli.


NO ACCUSED DNA LINKS


Masetla who has 25-years experience in forensics told the court that no DNA of the suspects was found on the swabs taken from the scotch hat that was found on the scene. He explained that they found a mixture of DNA results on the scotch hat that was found. Masetla told state prosecutor advocate George Baloyi that, "If your DNA is not found at a crime scene, using my common knowledge then you didn't touch anything on the scene and I wouldn't want to go into that. It is important for us to say someone is included, only if their DNA has to be found in all the regions. Finding DNA in one region doesn't mean their DNA is there," he responded.



ACCUSED 2 SCRUTINISED


The next witness called was Hendrick Louis Mulder, human resource manager at Sibanye Gold Mine were accused 2 Bongani Ntanzi used to work. Mulder said that on the 25th of October 2014, their system reflects that Ntanzi clocked out at 06h01AM. However, he was at work for about two hours. "On the 26th, 27th, 28th, 29th and the 30th of October and on the 1st of November 2014 Ntanzi didn't clock in at work. Ntanzi did submit a leave request for the dates 27th October until the 31st of October 2014, this was an unpaid leave request for personal problems," said Mulder. He said their system would have reflected if accused two was at the hostel on the 26th of October 2014. Mulder was briefly cross examined by Advocate Sipho Ramosepele who represents accused Ntanzi. Baloyi then submitted accused two's bank records from Capitec but the rest of the defence objected to this stating that they were not furnished with the documents from the bank. "We are at a stage that we want to start the trial within a trial, it's unlikely we will be sitting tomorrow,"said Baloyi. The judge then ordered that Mulder be recalled for cross examination despite the fact that the rest of the defence said they had no questions for him.
