Yesterday marked exactly nine years since the brutal murder of goalkeeper Senzo Meyiwa at his musician girlfriend Kelly Khumalo's home in Vosloorus. To this day, there has been no justice and no one has been truly held accountable for Meyiwa's death. Five men are currently standing trial at the North Pretoria High Court.
The court is still dealing with a trial within a trial when it heard that accused 2 Bongani Ntanzi made his first confession three days after his arrest and without any legal representation. The court heard that Ntanzi made his first confession statement to a Peace Officer at the Moroka Police Station in Soweto, without any defence. This is according to the state's latest witness Lieutenant Colonel Mohale Raphadu who claimed all the accused rights were explained to him.
"Do you wish to contact a legal practitioner of your own choice or apply to legal aid before you proceed to make this statement? The answer was ?No'," said Raphadu. Do you have the name of a legal practitioner or an attorney that I can call now. The answer was that:" I do not have any lawyer and I do not want the use of an attorney, nor the legal aid, I am giving freely this statement," the police officer told the Pretoria High Court about Ntanzi's response.
The defence has said they will challenge the admissibility of the first statement as they did with the second where Magistrate Viviene Cronje claimed the accused gave his confession willingly and had not been assaulted or coerced into admitting anything related to Meyiwa's murder. The court adjourned early on the state's request to allow a court interpreter, who they say was feeling ill, time to recover.
