MaMkhize set to lose luxury cars worth millions to SARS debt

Mamkhize is in trouble with the taxman

Reality television personality Shauwn 'Mamkhize' Mkhize real name Mabong Flora Junior Mpisane faces the risk of losing luxury vehicles valued at millions of rand. SARS have applied for the execution application at the Pietermaritzburg High Court on May 9 to seize 13 luxury cars under a trust owned by Shauwn's brother Melusi Sphelele Hugh Mkhize and her two nieces. Curator Jaco Venter was appointed to conduct inspection at Shauwn's business premises for the

Royal AM, owned by Shandi Trust, is in legal trouble due to an outstanding tax bill of nearly R38 million. The curator, Venter, visited Shauwn's luxury residence in La Lucia, Umhlanga, KwaZulu Natal to confiscate the vehicles, which include a Rolls Royce Cullinan, Porsche Urus, Mercedes-Maybach, 2 BMWs X6, and a BMW X5, among others. According to a source, Shauwn and her son Andile Mpisane, who serves as the club's chairman, were not present at their La Lucia home when Venter, accompanied by SARS security personnel, arrived unannounced. Legal documents that ZiMoja has seen were served against Shandi Trust, owned by two of Shauwn's nephews and her brother. SARS officials also visited Shauwn's mansion in Sandton, Johannesburg, to serve her with documents for the attachment of additional movable assets. SARS officials and the curator simultaneously arrived at both properties in Durban and Johannesburg to serve the Royal AM owners with the necessary court documents.

STAND-OFF BETWEEN CURATORS AND MAMKHIZE'S SECURITY

A source who knows the Mpisane family said Shauwn had an army of her private security guards who prevented Venter and the security guards from entering her Sandton property. "There was a standoff between the two security companies, and the police were called in to quell what might have been a bloodbath. "She blocked the garage windows with newspapers so that there would be no clear view as a signal that she has been tipped off that SARS and the curator will be coming to attach and remove assets. Shauwn didn't care about the court order and SARS officials called the police to intervene," said the source. Another insider who is closer to both Shauwn and her estranged husband Sbu Mpisane mentioned that Mpisane has lost everything while awaiting the completion of the divorce settlement. "Sbu stated he would pay double the amount she requested, and the case was postponed indefinitely," the insider stated.

STILL LEGALLY MARRIED

Mpisane and Shauwn remain legally married until the High Court decides on their ongoing divorce. In a recent development this week, Mpisane was shocked to discover that SARS had seized cars owned by him and Shauwn, even though they are now registered under a new name, Shandi Trust. The trustees of Shandi Trust are Sipokazi Zuma (32), Brightness Senzekile Mseleku (33), and 43-year-old Melusi Mkhize, Shauwn?s younger brother. A surprised Mpisane told ZiMoja that he established the Mkhimpi Family Trust - a combination of Mkhize and Mpisane names and was recently informed that it no longer exists. A bewildered Mpisane told Zimoja: "I am the founder of Mkhimpi Family Trust. I registered the entity. I am not sure how the family trust changed its name unless it was done fraudulently." he said. In an interview in April with the investigative TV show, Carte Blanche, the presenter presented Shauwn with documents proving she was convicted of tax fraud in 2005. Shauwn did not react well and abruptly left the interview before it concluded.

AN EXECUTION APPLICATION

In the meantime, the High Court ruled that the preservation order would remain in effect until August when the three applicants of Shandi Trust decide to contest it. "The respondents are hereby required to demonstrate, if any, on the return day, 2 August 2024, why the order should not be finalized. "The curators are authorized to take all necessary measures to ensure that the shares held by the Shandi Trust in Royal AM Football Club (PTY) LTD, registration under 2019/412459/07, and DPA Project Managers and Facilitators (PTY) LTD, registration number 2016/327140/07, are transferred to the curator bonis' name (Venter)," read the court judgment. The source said: "With the court taking action against Shandi Trust, it means that Andile is not a shareholder of DPA Project Managers and Facilitators (PTY) LTD, which is the holding company of Shandi Trust. Since Zikhulise was found guilty of tax fraud, a source alleges that Shauwn is conducting businesses through DPA Projects. MaMkhize and her PR management could not be reached for a comment.
