Luke Fluers murder accused acquited of possession of firearms and possession of ammunition charges

Matter against six men accused of killing Kaizer Chiefs defender postponed

The bail applications of the six men accused of hijacking and murdering Kaizer Chiefs defender Luke Fleurs was heard at the Roodepoort Magistrates Court today. Their accused's bail affidavits were read in court and all accused intend to plead not guilty and claim to have nothing to do with the tragic incident.

The six accused, Ndumiso Ndura Moswane (26), Fernando Nando Sive (25), Nhlakanipho Dlamini (21), Franky Xaba (25), Maredi Mphahlele (36) and Thembinkosi Hlanikhawu (31) were previously remanded in custody after their Legal Aid representatives were not present during their second appearance. Five of the accused have no previous convictions except for accused number 6 who has spent 4 years in prison in another matter. The accused are charged with murder with common purpose, robbery with aggravating circumstances and defeating the ends of justice. State prosecutor, Shadrack Temeki told the court that the possession of firearms and possession of ammunition charges were struck off the roll. The six accused told the court that they could each afford R 1 000 bail if granted. They also intend to plead not guilty to the charges.


POSTPONEMENT 


Magistrate Delise Smith postponed the matter to the 2nd of May for the state to verify certain aspects that they identified as concerns in some of the accused affidavits for their bail application. Luke was killed during an alleged hijacking at a petrol station in Roodepoort, Joburg, on 3 April. Gauteng police arrested the six suspects on Wednesday, 10 April. Luke was buried last weekend in Cape Town.
