Judge finds City of Joburg partly responsible for Usindiso tragedy

Judge Khampepe has found `City of Johannesburg partially responsible for the Usindiso Building Fire

Former Justice Sisi Khampepe has partially put the blame on The City of Johannesburg and its entities for the deaths of the 76 people who died in the Usindiso building fire.

Khampepe announced the findings of her inquiry report after months of testimonies and an arrest after a confession that was made by one of the residents.


ACCOUNTABILITY 


As part of her recommendations, Judge Khampepe advised directors at the Joburg Property Company, to take action against CEO Helen Botes emphasising that the city did not follow its own by-laws, which then majorly contributed to this tragedy.

?In the limited time that the commission was able to probe the circumstances around the fire, there was no opportunity to drill down to the individuals in the various entities that must bear responsibility and accountability.?


NOT SUITABLE FOR HUMANS


Khampepe blamed the City for entering into a lease agreement with the owners without verifying if the building was suitable for residential use.

?The building was vandalised by the removal and sale for cash of steel reinforcements supporting its columns, pillars and slabs. The City of Johannesburg and Joburg Property Company never attended to repairs and maintenance of the building.The accumulation of waste, the presence of unhygienic and unsanitary conditions, the existence of overcrowding and the occupation of the building without a sufficient supply of portable water is evidence of contraventions of Sections 5,6,7 and 38 of the Public Health bylaws,? said Khampepe.

Meanwhile the man who confessed to starting the fire that claimed 76 lives is still behind bars facing charges of arson, 76 counts of murder and 120 counts of attempted murder.

The first part of the commission was completed last month.The second part of the commission is set to begin in July with the final report expected at the end of August.
