The Johannesburg Magistrates Court has relaxed the bail conditions of TV presenter and musician Molemo "Jub Jub" Maarohanye. On Tuesday, his defence Advocate Terrence Baloyi applied for the bail conditions of his client to be relaxed and the verdict was heard today.

PERMISSION TO TRAVEL PLEASE

Addressing the court, Baloyi referred to an affidavit with his client's request, stating that Jub Jub had to travel out of the country for work purposes. "In our 7-page affidavit my focus will be on paragraph 29 and 30 where we are requesting the passport for the purposes of travelling and to perform outside of South Africa that is in Lesotho,Mozambique and Botswana," said Baloyi. He explained that the first gig will be on Botswana on the 27th of April, second gig in Lesotho on 2 June and 29 June in Mozambique.

"We have an annexure at the end of the affidavit as confirmation of these trips, therefore we request the passport for the purpose of travelling and further we humbly request the court to allow my client to be in possession of his passport for the rest of the year. He will then have to report to the investigating officer as suggested by the court." The magistrate presiding over the matter told Baloyi that he was starting with the "tale instead of the head".

VERDICT

State prosecutor Advocate Nel said she does not have a problem with the passport being handed over but was against the fact that Jub Jub will have it for the rest of the year. "It will not be in the interest of justice to have the bail conditions fully relaxed; we have to consider the charges he faces. For now, it may sound like we want to inconvenience the accused but that is not the case. He will come to the court whenever he has another gig to attend and we will know about all his movements," she said. The magistrate ruled that, "He was not comfortable to cancel all together bail conditions 3 and 4. I will make an order amending bail condition number 3 and 4 for the applicant who is the accused in this matter to be able to leave the Republic of South Africa for the period of 26 April 26 to July 30, 2024. The passport has to be returned back on the 1st of August 2024. Any amendments to the bail applications will be heard by the court."
