The Alexandra Magistrates Court has withdrawn a warrant of arrest for TS Galaxy soccer star, Thamsanqa Gabuza, after he provided the court with a doctor's note. A warrant of his arrest was issued last month when he failed to appear in court after he was granted bail in the damage to property matter.
Gabuza's lawyer, Themba Ngoben,i told the court that his client was not deliberately absent from court, but it was due to an illness. Ngobeni provided the court with a letter from the doctor as evidence that indeed Gabuza was not well on the day of his appearance last month. The magistrate presiding over the matter, Bulelani Mbeleni, accepted the doctor's note but stated that the court could not proceed with the matter today. "We would also like to cancel the warrant of arrest that was issued out. However, we cannot proceed hearing the matter as the court recording machine is not functional, therefore the matter is postponed to next month" Mbeleni said.
A case was opened by Zikhona Zode, an online teacher, who claimed she was in a relationship with Gabuza but when the relationship didn't work out they decided to be friends but that too failed. She alleges that on the day of the incident, Gabuza escorted her home, thereafter he tried to make advances towards her, but she refused and that's when the football legend lost it and broke her phone. The footballer was arrested in November 2023 after handing himself over to the police and charged with malicious damage to property. Gabuza was granted R3000 bail and ordered not to commit the same offence again. His case was postponed for further investigations and acquiring a quote for the damaged property. He will re-appear in the same court at the end of next month.
