The extradition case matter of the two brothers, Siyabonga Ndimande and Malusi Ndimande, who were arrested in eSwatini in connection with the murder of musician Kiernan 'AKA' Forbes and his friend Tebello "Tibz" Motsoane has been postponed to 14 May. The two Ndimande brothers who are also accused of two other murders, which they alleged committed last year, were arrested at a house they were renting in Mbabane in February.
NOT GOING ANYWHERE?
A few weeks ago, the case was postponed to allow the defence to go through the 254 pages of the official extradition application. Today, the defence, Sivesonke Ngwenya, told the court that they were not ready to proceed and had not completed going through the bulky extradition papers. "As the court pleases your worship, we would like to indicate that we intend on opposing the extradition application for my clients." Magistrate David Khumalo said he was postponing the matter so that the respondents could fully review the extradition papers from South Africa. "The applicants have not opposed this request. So, on 14 May, when the matter comes back to court, it is ordered that the respondents come back to the court having fully gone through the papers and having taken full instructions, including indicating whether or not the application has been opposed."
BAIL HEARING FOR OTHER ACCUSED ONGOING
Meanwhile, the bail hearing of the five other accused in the AKA and Tibz murder has been ongoing in the Durban Magistrates Court for a few weeks. Lindokuhle Thabani Mkhwanazi (30); Lindani Ndimande (35); Siyanda Myeza (21) Mziwethemba Gwabeni (36) and Lindokuhle Ndimande (29) said in their bail application that they will plead not guilty to all the charges they are facing. They face charges of money laundering, conspiracy to commit murder, murder, unlawful possession of a firearm, unlawful possession of ammunition and five counts of attempted murder.
