The six men accused of the murder of Kaizer Chiefs defender Luke Fleurs appeared at Roodepoort Magistrates Court again today for the continuation of their bail hearing. The court heard that the accused seem to be protecting the real culprits who are still at large. The six accused, Ndumiso Ndura Moswane (26), Fernando Nando Sive (25), Nhlakanipho Dlamini (21), Franky Xaba (25), Maredi Mphahlele (36) and Thembinkosi Hlanikhawu (31) are still applying for their bail.
State prosecutor Arnold Limekhaya told the court that cellphone records show that an unknown person told accused number 4, Franky Xaba, that if they were to be arrested for the crime, they should confess to protect the actual suspects identity. Limekhaya read an affidavit by the investigating officer Seargent Nare Moloto, which read: "During the arrest, Xaba's mobile phone was seized and communication with an unknown person was discovered. The communication was to the effect that if the applicants get arrested, they must confess to the crime because they do not want their names to come out as they will also be arrested. This is evidence from the intercepted communication." The court also heard that one of the accused, Fernando Sive, is in the country illegally after his permit expired in 2020. The state said it believes that the suspects are part of a gang that hijacks, strips and sells car parts on the black market.
The National Prosecuting Authority's Phindi Mjonondwana indicated that additional individuals may be implicated as investigations progress. "At this stage, the progress into investigations highlights that the safety of witnesses and suspects cannot be assured." The six suspects face charges of murder, robbery under aggravating circumstances, and defeating the ends of justice since they were acquitted from the charges of possession of unlicensed firearm.
