The City of Johannesburg Executive Mayor Kabelo Gwamanda has confirmed the re-appointment of Floyd Brink as the City's manager. This follows a judgment by the High Court three weeks ago which ruled that Brink who was appointed during the previous mayor's administration was unlawful and invalid.
On Monday, the court denied the City's request for leave to appeal the ruling and the City indicated that it would approach the Supreme Court of Appeal (SCA) to overturn the High Court decision. Gwamanda said the city still believes the High Court failed to independently and without bias consider the valid and substantial legal arguments presented before it on the process enlisted by the council in approving the report to appoint the city manager earlier this year.
Gwamanda said the council's decision now renders the intention to petition the Supreme Court of Appeal on the same matter. "On behalf of the City we once more congratulate Mr Brink on his appointment and look forward to continued administrative stability and uninterrupted delivery of services," he said. City spokesperson Virgil James said Brink was re-appointed after the council followed due process, which it had failed to do the first time.
