The alleged rapist and murderer of Sandton teacher, Kirsten Kluyts, appeared at the Alexandra Magistrates Court yesterday in an attempt to appeal his bail.
The accused, Bafana Mahungelwa, was denied bail in December with Magistrate Syta Prinsloo stating that he poses a danger to society and had deliberately disposed the deceased clothing to conceal crucial evidence.
Prinsloo postponed the matter to 10 May after having an argument with the accused?s defence who claimed that he was displeased with the magistrate?s conduct. Itumeleng Masako, representing the accused, threatened to report Prinsloo to the Magistrates Commission.
"We cannot go on like this, we must change for the better, at least,? said a visibly frustrated Masako.
The accused maintained that he did not kill Kluyts but only came across her dead body on a path.He claimed that he only touched her because he wanted to check if she was still alive.
Upon realising that she was dead, he claimed to have panicked and decided to undress Kluyts because he didn?t want to be implicated in the murder. He decided to take her clothes to protect his DNA and report the matter to the Police.
Kluyts who was three months pregnant, at the time was found murdered at the George Lea Recreational Park in Parkmore, Sandton, on October 29 while she was participating in a MyRun event.
