Bafana Mahungela, the young man accused of murdering Sandton teacher Kirsten Kluyts, was back at the Alexandra Magistrates Court yesterday for the continuation of his bail bid. Mahungela faces charges of pre-meditated murder and robbery with aggravated circumstances. The state added a charge of rape yesterday. CCTV video footage from the day of the incident became an important piece of evidence. The prosecution told the court that Mahungela was seen on camera tailing Kluyts before they both disappeared down an embankment at George Lee Park.
Despite the CCTV evidence, Mahungela insisted that he had nothing to do with the stalking, raping and killing of Kluyts on the day of the race. Kluyst was participating in the MyRun event in Sandton on 29 October. "I can't just come from a party the previous day, go home to go submit an assignment and decide ?I'm going to kill someone now'. How does that benefit me?," asked Mahungela, who was caught on camera wearing the deceased blue T-shirt and claimed that he took her clothes because they had his fingerprints and he feared being arrested. "I took the clothes and then I ran. I was running away because I was shocked that I was just with a dead body so if I left my fingerprints there. They were going to say I am the one that killed her so it's better I took what I touched and I went," he said.
Mahungela claimed that the police never read him his constitutional rights during his arrest. "He didn't say anything to me. He just asked me ?Is this you in the photo?'. I said yes and they started putting handcuffs on and slapping me," the accused claimed. He claimed that the police didn't read him his rights again at the police station. "They asked me to unlock my phone but told me I had a right to refuse. I opened it because I wanted to show them the pictures from the pyjama party in Tsutsumani," Mahungela explained. Mahungelwa will be in court again this morning to know his fate.
